Terms & Conditions
1. Scope
These General Terms and Conditions apply to all DJ services provided by manulive (Manuel Seiler) at weddings, corporate events, private parties and other events. The contracting party is the person or company booking the service (hereinafter the “organiser”). Deviating terms only apply if agreed in writing.
2. Offer and conclusion of contract
Offers are non-binding and valid for one month. The contract is concluded once the organiser accepts the offer in writing (email is sufficient) or by phone and manulive confirms the booking. The date is only reserved bindingly once any agreed deposit has been received.
3. Scope of services
The type and scope of the service (playing time, equipment, lighting, microphone, extras) are set out in the respective offer. Music is selected according to the wishes discussed in the preliminary meeting; the specific set on site is at the DJ’s artistic discretion. Extending the playing time is possible by arrangement on site and is charged at the agreed hourly rate.
4. Prices and payment
The prices stated in the offer apply. A deposit of 50 % is due upon booking, the balance no later than 3 days before the event. Travel costs outside the area stated in the offer are charged separately. No VAT is shown (small-business exemption under § 6 (1) no. 27 Austrian VAT Act).
5. Cancellation by the organiser
Cancellations must be made in writing. Deposits already paid are non-refundable upon cancellation unless agreed otherwise. In addition, the following cancellation fees apply, based on the agreed total price:
up to 28 days before the event: 25 % in addition to the deposit paid
up to 7 days before the event: 50 % in addition to the deposit paid
thereafter: 100 %
6. DJ unable to perform
If manulive is unable to attend for an important reason (e.g. illness, accident, force majeure), manulive will try to arrange an equivalent replacement DJ. If this is not possible or the organiser declines the replacement, all payments made will be refunded in full. Further claims are excluded to the extent permitted by law.
7. Organiser’s obligations
The organiser provides free of charge and in good time before the start: a suitable, dry and level set-up area, a protected power supply (230 V) close by, free access or parking for unloading and, for longer bookings, food and drinks for the DJ. Set-up usually takes place on the day before the event or as agreed.
8. Official registrations, AKM and permits
The organiser is solely responsible for obtaining all registrations, notifications and permits required for the event in good time and for paying any associated fees. This includes in particular:
– registering the use of music with AKM (Austrian music rights society) and paying the licence fees, if the event is public or subject to registration;
– any event registration or permit with the municipality or authority under the relevant provincial event law;
– compliance with noise regulations, closing hours, youth protection and safety rules at the venue.
manulive accepts no liability for costs, fines or disadvantages arising from missing or late registrations. If the event has to be stopped or the volume reduced by the authorities for this reason, the claim to the agreed fee remains.
9. Volume and safety
The DJ follows the requirements of the venue and the organiser. The DJ may interrupt or end the performance if the safety of people or equipment is at risk (e.g. due to weather, lack of protection or assaults), without losing the claim to the fee.
10. Liability
The organiser is liable for damage to manulive’s equipment caused by the organiser or their guests. manulive is only liable for damage caused intentionally or through gross negligence; this does not apply to personal injury. Section 8 applies to compliance with official requirements.
11. Photos and videos
manulive may take photos or videos of the DJ set-up during the event for its own promotion (website, social media). Guests are only shown recognisably with the express consent of the organiser or the persons depicted. The organiser may object to such use in writing at any time.
12. Right of withdrawal for consumers
For contracts concluded with consumers at a distance (e.g. by email, phone or via the website), there is no right of withdrawal under § 18 (1) no. 10 of the Austrian Distance and Off-Premises Contracts Act (FAGG), as the services relate to leisure activities for which a specific date has been agreed. Section 5 applies to cancellations.
13. Final provisions
The court with subject-matter jurisdiction at the seat of my business shall have local jurisdiction to decide all disputes arising from this contract. Any agreements deviating from these Terms and Conditions must be made in writing. In case of doubt, the German version applies.
EU dispute resolution: I am not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
